Terms

By downloading, installing or using the Swipe Tennis app ("the app") you agree to the following terms. If you do not agree, do not use the app.

These terms form an agreement between you ("user") and Michael Hubert Becker, Feierabend Apps, Obere Dorfstr. 6B, 90427 Nürnberg, Germany, contact: hallo@feierabendapps.app ("developer").

Apple Inc. is not a party to these terms.

1. Licence

The developer grants you a limited, non-transferable, non-exclusive right to use the app on Apple-branded devices you own or control, within the Apple Media Services Terms and Conditions.

2. Price

Swipe Tennis is offered as a one-time purchase, with no subscription, no in-app purchases and no ads. Apple handles the payment. Beta versions through TestFlight are free and may contain bugs.

3. Rules of use

You agree not to reverse engineer, decompile or disassemble the app, not to circumvent security measures and not to use the app for unlawful purposes.

4. Content and names

All characters, opponents and names in the game are fictitious. Any resemblance to real persons is unintended.

5. Warranty and liability

Statutory warranty rights apply. The developer is liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence the developer is liable only for breach of an essential contractual obligation, limited to the foreseeable, typical damage. Liability under the German Product Liability Act remains unaffected.

6. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected. If a provision is invalid, the rest remains valid.
